1. Acceptance

These Terms of Use (the “Terms”) govern your access to and use of the Foundation AI Advisory website at foundationaiadvisory.com (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. About Foundation AI Advisory

The Site is published by Foundation AI Advisory, LLC, an Ohio limited liability company (“Foundation AI Advisory,” “we,” “us,” or “our”). The Site exists to describe Foundation AI Advisory’s services, share AI Advisory, and provide ways to contact us. Any advisory work Foundation AI Advisory performs for a client is governed by a separate signed engagement letter, not by these Terms.

3. No Professional Advice

Content on the Site is provided for general information only. It is not legal, accounting, tax, investment, or other professional advice, and it is not a substitute for the judgment of a qualified advisor who knows your specific situation. Do not act or refrain from acting based on Site content without professional counsel.

4. Permitted Use

You may use the Site for lawful business purposes consistent with these Terms. You agree not to:

• Copy, reproduce, distribute, or republish substantial portions of Site content without our prior written consent;
• Use automated tools to scrape, crawl, or harvest the Site beyond what robots.txt allows;
• Reverse-engineer, decompile, or attempt to extract source code beyond what is delivered to your browser;
• Interfere with the Site’s operation, security, or other users’ use of it;
• Use the Site or its content to train machine-learning models without our prior written consent;
• Misrepresent your identity, affiliation, or the source of any submission.

5. Intellectual Property

The Site and its content — including text, images, graphics, logos, methodology names, frameworks, and source code — are owned by Foundation AI Advisory or our licensors and are protected by copyright, trademark, and other intellectual-property laws. “Foundation AI Advisory,” the Foundation AI Advisory logo, and the names of Foundation AI Advisory offers and methodology pillars are trademarks of Foundation AI Advisory. No license to any of this material is granted except as expressly stated in these Terms.

You may view and download Site content for your internal business reference, provided you do not remove copyright or other proprietary notices. Quoting short excerpts of AI Advisory is permitted with attribution to Foundation AI Advisory and a link to the source page.

6. Submissions

If you send us suggestions, feedback, or other unsolicited materials through the Site or by email, you grant Foundation AI Advisory a non-exclusive, royalty-free, perpetual, worldwide license to use them for any lawful business purpose, without obligation to you. Do not send confidential information to us through web forms; share confidential material only after a written confidentiality agreement is in place.

7. Third-Party Links and Services

The Site may link to third-party websites, podcasts, or other resources. We do not control those resources and are not responsible for their content, policies, or practices. Following such links is at your own risk and subject to the terms of those third parties.

8. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Foundation AI Advisory does not warrant that the Site will be error-free or that any defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by law, Foundation AI Advisory and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site, even if Foundation AI Advisory has been advised of the possibility of such damages. Foundation AI Advisory’s total aggregate liability arising from or related to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Foundation AI Advisory and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Privacy

Use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

12. Changes

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be communicated through the Site. Continued use of the Site after a change constitutes acceptance of the updated Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Ohio, and you consent to personal jurisdiction and venue in those courts.

14. Miscellaneous

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Foundation AI Advisory regarding the Site and supersede any prior or contemporaneous understandings on that subject.
